Welcome to Moda Concept Store. These Terms of Service govern all purchases made on our website, in accordance with the French Consumer Code and French Civil Code. By placing an order, you accept these Terms in full.

2. Purpose

Moda Concept Store operates an e-commerce website selling clothing and apparel to consumers in France. These Terms define the rights and obligations of Moda Concept Store and its customers in connection with online sales.

3. Products and Prices

Product descriptions, images, and prices are provided as accurately as possible. Minor variations in color, texture, or sizing may occur due to screen display or manufacturing batches. Prices are displayed in Euros (€) and include applicable French VAT, unless stated otherwise. Moda Concept Store reserves the right to modify prices at any time; the price applicable is the one displayed at the time of order confirmation.

4. Order Process

Orders are placed directly through our website. Upon completing checkout, you will receive an order confirmation email summarizing your purchase. This confirmation constitutes acceptance of your order, subject to product availability and payment validation. Moda Concept Store reserves the right to cancel or refuse any order in cases of suspected fraud, pricing errors, or unavailability of stock, and will notify the customer promptly with a full refund if applicable.

5. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, you have a legal right of withdrawal of 14 calendar days from the date of receipt of your order, without needing to provide a reason. Beyond this legal minimum, Moda Concept Store extends this right to 30 calendar days as a commercial goodwill policy — see our Refund & Return Policy for the full return process, including our free prepaid return label and no-fee return process.

6. Delivery

Delivery terms, timeframes, and rates are detailed in our Shipping Policy. Risk of loss or damage transfers to the customer upon delivery of the goods, in accordance with Article L216-4 of the French Consumer Code.

7. Payment

Payment terms, accepted methods, and security measures are detailed in our Payment Policy (Section 5 below).

8. Legal Guarantees

Independently of any commercial return policy, all products purchased from Moda Concept Store benefit from the following legal guarantees under French law:

• Legal guarantee of conformity (garantie légale de conformité, Articles L217-3 et seq. of the French Consumer Code): products must conform to the contract description. This guarantee applies for 2 years from delivery.
• Guarantee against hidden defects (garantie des vices cachés, Articles 1641 et seq. of the French Civil Code): applies where a defect existed at the time of purchase but was not apparent.

9. Intellectual Property

All content on this website — including the Moda Concept Store name, logo, product photography, descriptions, and design — is the property of Moda Concept Store and protected under French intellectual property law. Reproduction without prior written consent is prohibited.

10. Liability

Moda Concept Store cannot be held liable for delays or non-performance caused by events beyond its reasonable control (see Section 4.13, Force Majeure), nor for indirect damages arising from use of the website, to the extent permitted by French law. This does not affect your statutory rights as a consumer.

11. Personal Data

Any personal data collected during your use of this website is processed in accordance with our Privacy Policy (Section 3), in compliance with the GDPR and French data protection law.

12. Consumer Mediation

In accordance with Article L616-1 of the French Consumer Code, if a dispute cannot be resolved directly with our customer service, you are entitled to free access to a consumer mediator.

13. Force Majeure

Moda Concept Store shall not be held responsible for any delay or failure to perform resulting from circumstances beyond its reasonable control, including natural disasters, strikes, courier disruptions, or governmental restrictions.

14. Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, and after attempting amicable resolution (including mediation as described above), the competent French courts shall have jurisdiction, in accordance with applicable consumer protection rules.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We may update these Terms periodically to reflect changes in our practices or legal requirements. The version in effect is the one published on this page at the time of your order.
